Municipal Liability

Cities, Towns, Police Departments, School Districts, and even States can be held responsible for injuries caused by their negligence and that of their employees.  If you have tripped on a broken sidewalk, your child gets hurt at school, you have been hit by a city bus, or you have been wrongfully assaulted or arrested by a police officer, you may be able to bring a claim for the injuries sustained, but only if you have followed the very strict rules that apply to suing municipal defendants.  In New York, virtually every type of claim against a city, town or government agency requires that a Notice of Claim be filed with the responsible entity within 90 days of the date of the accident. Under certain circumstances a Court may allow you to file a Notice of Claim beyond the 90 day deadline, but it is best to consult with an attorney knowledgeable about municipal liability before the 90 days expires.  Also, unlike in cases against private defendants, municipal defendants are protected by a much shorter statute of limitations, which is the time in which you must start a lawsuit, which for municipal defendants is just 1 year and 90 days.
